Freak accidents on the road
Accidents are never a pleasant experience. The view of an accident can make one sick. There are several incidences when freak accidents can occur. Some popular examples are seen below:
Passengers vs. A lorry
On a road under construction, a lot of dust is experienced. Cars moving in either opposite direction or the same direction may not be visible. The visions of the drivers are impaired due to the dust. This results to distraction and poor ability to detect a problem. A passenger car and multi-passenger van passing on the same route can experience a lot more difficulties because;
• Its small size makes it quite invisible hence high chances of accidents.
• The road has pot holes making the vehicle move slow increasing the chances of collision.
On the other hand a lorry with a larger size is quite elevated. The driver does not experience much of the dust and can see better than the other driver in the passenger vehicle. But this doesn’t guarantee that an accident will not occur.
As the passengers’ driver tries to escape pot holes in the poorly conditioned road, they ram directly into the side of a moving track. The track passes over the front part of the van destroying it before stopping. The van looked like a ball. Can you imagine how many people survived out the fourteen passengers? None at all
A stray car hits school children
Children from school were knocked down by an over speeding car! How weird is this? The car was obviously moving faster than it should especially when on the road with young school children. Five school children die on the spot. The cars itself roll over and over several times before falling into the nearby ditch. The driver and the two passengers are found embedded into the metal of the car. The car had to be cut into pieces in order to collect the remains of the passenger’s. What a freaking accident!
A lorry that caused a fire
This is a lorry that carries petroleum products from the refineries to the petrol stations. It has to move at high speed in order to deliver its product on time. The lorry moves on the main highway with other vehicles. Abruptly the vehicle burst into flames from the rear. The driver has no idea and continues speeding the lorry. Soon the whole rare is on fire. Other vehicles that are approaching stop but the two that were close to overtake cat fire.
The traffic is at a stand still. The affected people try to run away from their vehicle but one car does not open the door. It was not fit to be on the road. The fire spread across as the firefighters try to stop it. It is too late, the man, wife and children die in the dreaded fire.
A lorry carrying goods fall on a lady
Truck carrying maize to drought affected area is packed on the roadside. This is a busy road that hawkers usually trade. This place is usually busy so a woman takes rest besides the truck and unfortunately falls asleep. When the track driver comes, he goes directly to the wheel, starts the vehicle and tries to pull away. This action is not success full as one trailer ticks in the terrace. More effort to pull out causes it to fall. The poor lady who had woken up, trying to escape was not lucky. The whole weight was on her. Did she survive or rather was she recognizable?

- The percentage of all traffic deaths caused by distracted driving rose from 11% in 1999 to 16% in 2008.
- Distracted-driving crashes are more common in urban areas. Overall, 40% of all crashes happened in urban areas in 2008, up from 33% a decade earlier.
- Only one-third of Americans had a cell phone in 1999. By 2008, 91%.
- The average monthly volume of text messages was 1 million in 2002. By 2008, it was 110 million.

3 Children Injured in Los Angeles Hit and Run Accident

On October 29th three young children were struck by a car which then left the scene. The boys were only 4 and 6 years old. Their sister was the oldest at 11 years old. The three children were all taken to a local hospital. None of the children sustained life threatening injuries.
It is unbelievable that any driver could be so cold-hearted as to leave the scene after injuring three children. They driver may have fled in terror of the consequences, but has just increase their problems dramatically. The driver can now be tried his actions under the California Vehicle Code. They may discover their days of driving freely about the community have been replaced with walking around a courtyard in an orange jumpsuit.
The Continuing Pain for the Family
The second part of this tragedy is on the financial side. In an accident of involving pedestrians the driver’s auto insurance is often responsible for paying for the medical costs. At this time the family of the children is facing a major financial challenge through no fault of their own. Even with a fast recovery the cost will be thousands of dollars.

Navy Man Dies in Multiple Car Accident

Last week Thursday four cars were involved in a major accident on State Route 15 near Ocean Boulevard. A man enlisted in the Navy was driving his Jeep Cherokee SUV at high speed down the highway. In an unusual driving maneuver, the driver turned right suddenly and lost control of the Jeep. The Jeep rammed into the side of a Honda Civic and then smashed into the rear of Cadillac De Ville. The impact caused the Cadillac to collide with a Toyota Corolla.
Due to the high-speed impact the Jeep flipped landing on top of the Cadillac. The drives in all 4 cars were men with 3 of them being in the military.
The unnamed driver of the Jeep was pronounced dead on the scene. Two of the other drivers sustained injuries. The only uninjured driver was in the Honda Civic, the first car hit. The driver of the Toyota was complaining about both neck and head pain before being transported to a local hospital. The driver of the Cadillac was also being evaluated and treated for possible neck and head injuries.
This deadly crash is certain to have started an avalanche of investigative work and legal wrangling. The insurance companies for all four drivers will be trying to determine responsibility for paying for damages and medical costs. It just makes sense. They do not want to spend money they do not need to spend.
Now here is an important question for us to consider when we think about this accident. Was the single navy man in the Jeep the only one responsible? Should his insurance company be the only one to pay for all of the damages? His Jeep never hit the Toyota Corolla.
Those are questions most of us have no answer for and hope we never need to know. What would you do if you were the driver of one of those other cars and an insurance company called you and started asking questions? Would you answer them?

Aviation accident attorneys have deplored the safety condition in Reno, however the FAA has not yet determined if this was a preventable disaster.

The manufacturer of this medication has not sufficiently warned patients of the potential risk. As a result, Actos® lawsuits are now under review across the nation. Microsoft Seeks Legal Action Against Barnes & Noble, Foxconn and Inventec

Horacio Gutierrez, Microsoft’s corporate vice president and deputy general counsel of Intellectual Property and Licensing, has made some statements that indicate Microsoft has fired legal shots against Foxconn, Inventec, Barnes & Noble who are associated with manufacturing of Nook color.
According to Microsoft these companies have broken the patent regulations in which some of the patents are owned by the corporate Microsoft who wants profit off those patents. Mr Gutierrez has made further claims that these companies have refused to fullfill the licensing condition and while he has been trying to reach them in regards to the licensing agreements he admits that he was quite unsuccessful in such endeavor. So Microsoft corporation had no other way and decided to pursue legal action against Barnes & Noble, Foxconn and Inventec.

Canadian Government’s stand against Ontario prostitution ruling

The battle against legalizing prostitution in Ontario continues. Minors being prostituted could potentially rise and sex workers coming to Ontario: That’s the dangerous scenario being showcased by the provincial and federal governments if the courts fail to uphold key provisions of the country’s prostitution laws.
The attorney who successfully challenged the laws that effectively criminalized prostitution says he doesn’t believe in the proposal that the federal that government will lay out at a hearing next week. The law remains in place but what will happen next.

Teen charged with attempt to fire gun on officer

Teen has been charged for attempted murder while trying to shoot a Toronto police officer.
Officers say the incident began when they started to question three males for an illegal crossing. When the police began to question the suspects began to run away.
They then began to chase the suspects and found narcotics with weapons.
One of the suspects then made a quick turn and tried to fire back at the officers. He was then apprehended and police seized another loaded gun.

Legal assistant ends up in a pile of trouble for lawyer impersonation

A legal assistant who is 34 years old was posing as a real lawyer and taking money from people who thought they were paying legal fees to their lawyer. This case comes from Zambia where James Mushanga of 2066/7 Chawawa Compound has been fully indicted on the charges of offence of an unqualified person trying to practice as real legal advocate. Additionally James Mushanga is facing two counts of getting the money from people by misleading and false pretences.
The details of the case come from the facts that Mushanga on certain dates between the August and September of 2007 knowing he is not advocate took a writ of summons by using his signature and undertaking civil proceedings in the high courts of Lusaka.
While posing as a lawyer Mushanga successfully acquired approx. K9.8 million from the cases he handled and claimed the money was going towards the legal services.

Credit Card Fraud: Who’s Legally Responsible?

Every year, credit card fraud costs the banking, retail, and service industries billions of dollars. In the United States, it is estimated that on average, 7 cents per $100 in transactions is fraudulent. In other countries, that amount is reportedly even higher.
Who Pays For It?
In the United States, federal law dictates that a credit card holder cannot be held responsible for more than $50, regardless of how much is charged. If unauthorized charges occur after you report your card lost or stolen, you are not responsible for any amount.
Although credit card companies can technically hold you liable for the first $50 in disputed charges, they rarely do. Nowadays most banks use “$0 fraud liability” as a marketing strategy. The American Express Platinum card and Centurion black card were some of the first to offer this as a benefit, but now all American Express cards do the same, as well as most other major banks.
Therefore, the financial institutions that issue and underwrite credit cards are almost entirely responsible for the cost of fraud.
Is Identification Required For Purchase?
Although many merchants ask for photo identification when processing a credit card purchase, they are not required to do so. In fact, Visa, MasterCard, American Express, and Discover actually have policies which discourage asking for ID. Instead, they state all that’s needed is the cardholder’s signature. Many favor this practice; claiming it makes transactions easier and faster. Meanwhile, others wish that photo IDs were required, in order to discourage unauthorized credit card usage.

Credit Cards Move Away From Forced Arbitration

Most consumers are unaware of the fact that they’ve given up the right to sue their credit card company. Instead, nearly every credit card agreement imposes forced arbitration in the event a dispute arises.
The financial institutions claim doing so cut costs, but consumer advocacy groups argue that it is unfair to customers. “Customers come to our message board all the time talking about how they are going to sue, but they’re left shell-shocked when they discover the truth” says Jennifer Holter, editor at Credit Card Forum (a message board for credit card reviews).
In what is being hailed as a major win for consumers, a number of banks have dropped their mandatory arbitration clauses during the past few months; Bank of America, Chase, and Capitol One. Although they largely claim the moves are voluntary, in reality it is probably from the pressure of a pending class action lawsuit filed by Philadelphia-based Berger & Montague. The suit alleges that credit card companies unlawfully colluded on arbitration terms. There are still four defendants listed in the lawsuit who have not yet settled; The National Arbitration Forum, Discover Financial Services, Citibank, and HSBC.
It’s important to note the credit card issuers whom have dropped their arbitration clauses may re-impose them in future. Reportedly, Capital One and Bank of America have only agreed to do so for three-and-a-half-years. None of the defendants who have settled admit liability or wrongdoing.

Divorce Law and Annulment

An annulment is different than a divorce in that it legally makes a marriage null and void. An annulled marriage is considered to have never existed. There are two types of annulment, legal annulment and religious annulment.
Legal Annulment
In order to have an annulment, it must be shown that the marriage was never valid to begin with. Some common reasons a marriage can be invalidated are:
- One spouse was under the legal age to get married at the time of the marriage
- One spouse suffers from mental illness, or was under the effects of alcohol or drugs at the time of the marriage
- One spouse was already married to someone else at the time of the marriage
- One spouse withheld important facts, such as a desire not to have children, inability to have children or having a serious illness
- The marriage was never consummated
- The marriage was between two people that are too closely related to be legally married, such as a parent and a child or aunt and a nephew
Religious Annulment
Religious annulments have nothing to do with legal annulments. They are granted by your religious institution, not your state. In some cases people obtain a divorce, and are later granted a religious annulment. Religious annulment requirements vary with each religion.
Differences Between Divorce and Annulment
The process of an annulment is very similar to a divorce. Similar papers must be filed and similar hearings are held. An annulment can usually be finalized much more quickly than a divorce. While annulments usually apply to short marriages, the duration of the marriage is not a factor in determining if an annulment is an option. For example, if two people were married for 30 years, but one of them was married to someone else first, it would qualify for annulment.
Because an annulment essentially means the marriage never existed, unlike with a divorce, there can be no claims for alimony or spousal support. Any children that were conceived during a marriage that was later annulled are considered legitimate children and child support, health care and visitation must still be determined for them. Some states are reluctant to grant an annulment for marriages that had children.

Clinics starting to help people to be represented in the court

Zina Butler is one of those people who did not know where to go when some of the county housing officers together with the sheriff and landlord came to her small and subsidized apartment approx. 2 years ago without providing and kind of advance notice.
Butler who is 46 said that she wanted to file lawsuit in which as she explained her Fourth Amendment right was violated. This Fourth Amendment right was supposed to prevent anyone from conducting illegal and not authorized searches and seizures.
However she was unable to find an appropriate attorney and was pretty scared of going through the legal system on her own. She then found a clinic located at the federal courthouse in the district of L.A which was providing assistance to the people who wanted to self represent themselves in the court. This was a blessing from the God, Butler indicated. If there was no clinics like these, people would just run over you, Butler added.
